We delete the data arising in this context after storage is no longer required, or restrict processing if there are statutory retention obligations. <\/p>\n\n<p><strong>1.4<\/strong><\/p>\n\n<p>Personal data is only collected on this website to the extent technically necessary. This data is used exclusively for the service you have requested (e.g. contacting us for advice about our formats). <\/p>\n\n<p><strong>1.5<\/strong><\/p>\n\n<p>Following the example of Art. 4 GDPR, this data protection notice is based on the following definitions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>&#8220;Personal data&#8221; (Art. 4 No. 1 GDPR) means any information relating to an identified or identifiable natural person (&#8220;data subject&#8221;). A person is identifiable if they can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, an online identifier, location data or information relating to their physical, physiological, genetic, mental, economic, cultural or social identity. Identifiability can also be achieved by linking such information or other additional knowledge. The origin, form or embodiment of the information is irrelevant (photos, video or audio recordings can also contain personal data).     <\/li>\n\n\n\n<li>&#8220;Processing&#8221; (Art. 4 No. 2 GDPR) means any operation which is performed on personal data, whether or not by automated means (i.e. using technical specifications). This includes, in particular, the collection (i.e. acquisition), recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction of personal data, or alteration of the purposes for which they were originally processed.   <\/li>\n\n\n\n<li>&#8220;Controller&#8221; (Art. 4 No. 7 GDPR) means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.  <\/li>\n\n\n\n<li>&#8220;Third party&#8221; (Art. 4 No. 10 GDPR) means any natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorized to process personal data; this also includes other legal entities belonging to the group.  <\/li>\n\n\n\n<li>&#8220;Processor&#8221; (Art. 4 No. 8 GDPR) is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller, in particular in accordance with the controller&#8217;s instructions (e.g. IT service provider). In terms of data protection law, a processor is in particular not a third party.   <\/li>\n\n\n\n<li>&#8220;Consent&#8221; (Art. 4 No. 11 GDPR) of the data subject means any freely given, specific, informed and unambiguous indication of the data subject&#8217;s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.  <\/li>\n<\/ul>\n\n<p><strong>1.6<\/strong><\/p>\n\n<p>For the processing operations carried out, we indicate below how long the data will be stored by us and when it will be deleted or blocked. Unless an explicit storage period is specified below, your personal data will be deleted or blocked as soon as the purpose or legal basis for storage no longer applies. <\/p>\n\n<p>However, data may be stored beyond the specified period in the event of an (impending) legal dispute with you or other legal proceedings or if storage is provided for by statutory provisions to which we are subject as the controller (e.g. Section 257 HGB, Section 147 AO). If the storage period prescribed by the statutory provisions expires, the personal data will be blocked or deleted unless further storage by us is necessary and there is a legal basis for this. <\/p>\n\n<h2 class=\"wp-block-heading\">2. legal bases of data processing<\/h2>\n\n<p>In principle, any processing of personal data is prohibited by law and is only permitted if the data processing falls under one of the following justifications:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Art. 6 para. 1 S.1 lit. a GDPR (&#8220;consent&#8221;): Where the data subject has voluntarily, in an informed and unambiguous manner, indicated by a statement or other unambiguous affirmative act that he or she consents to the processing of personal data relating to him or her for one or more specific purposes;<\/li>\n\n\n\n<li>Art. 6 para. 1 S.1 lit. b GDPR: If the processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;<\/li>\n\n\n\n<li>Art. 6 para. 1 S.1 lit. c GDPR: If the processing is necessary for compliance with a legal obligation to which the controller is subject (e.g. a legal obligation to retain data);<\/li>\n\n\n\n<li>Art. 6 para. 1 S.1 lit. d GDPR: If the processing is necessary to protect the vital interests of the data subject or another natural person;<\/li>\n\n\n\n<li>Art. 6 para. 1 S.1 lit. e GDPR: If the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, or<\/li>\n\n\n\n<li>Art. 6 para. 1 sentence 1 lit. f GDPR (&#8220;Legitimate interests&#8221;): If the processing is necessary for the purposes of the legitimate (in particular legal or economic) interests pursued by the controller or by a third party, except where such interests are overridden by the interests or rights of the data subject which require protection of personal data (in particular where the data subject is a minor).  <\/li>\n<\/ul>\n\n<p>For the processing operations we carry out, we indicate the applicable legal basis in each case below. Processing can also be based on several legal bases. <\/p>\n\n<p>Furthermore, the storage of information in the terminal equipment of you as the end user and access to information that is already stored in your terminal equipment will only take place after you have given your consent in accordance with Section 25 (1) TDDDG, unless this is dispensable in accordance with Section 25 (2) TDDDG.   <\/p>\n\n<h2 class=\"wp-block-heading\">3. your rights<\/h2>\n\n<p><strong>3.1<\/strong><\/p>\n\n<p>You have the following rights vis-\u00e0-vis us with regard to your personal data:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>to request information about your data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the processing purposes, the category of data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information about its details; <\/li>\n\n\n\n<li>in accordance with Art. 16 GDPR, to immediately request the correction of incorrect data or the completion of your data stored by us;<\/li>\n\n\n\n<li>in accordance with Art. 17 GDPR, to demand the deletion of your data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;<\/li>\n\n\n\n<li>in accordance with Art. 18 GDPR, to demand the restriction of the processing of your data if the accuracy of the data is disputed by you or the processing is unlawful;<\/li>\n\n\n\n<li>in accordance with Art. 20 GDPR, to receive your data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller (&#8220;data portability&#8221;)<\/li>\n\n\n\n<li>pursuant to Art. 21 GDPR to object to the processing if the processing is based on Art. 6 para. 1 sentence 1 lit. e or lit. f GDPR. This is particularly the case if the processing is not necessary for the performance of a contract with you. If it is not an objection to direct advertising, we ask you to explain the reasons why we should not process your data as we have done when exercising such an objection. In the event of your justified objection, we will examine the situation and will either discontinue or adapt the data processing or show you our compelling reasons worthy of protection on the basis of which we will continue the processing;      <\/li>\n\n\n\n<li>in accordance with Art. 7 (3) GDPR, to withdraw your consent once given to us at any time (including before the GDPR came into force, i.e. before May 25, 2018) &#8211; i.e. your voluntary, informed and unequivocal declaration or other unambiguous confirmatory act that you consent to the processing of the personal data concerned for one or more specific purposes &#8211; if you have given such consent. As a result, we may no longer continue the data processing that was based on this consent in the future.  <\/li>\n<\/ul>\n\n<p><strong>3.2<\/strong><\/p>\n\n<p>In accordance with Art. 77 GDPR, you can complain to a data protection supervisory authority about the processing of your personal data in our company, for example to the data protection supervisory authority responsible for us.<\/p>\n\n<h2 class=\"wp-block-heading\">4. collection of personal data when visiting our website<\/h2>\n\n<p>We process the personal data specified below in accordance with the provisions of the GDPR, the Telecommunications Digital Services Data Protection Act (hereinafter: &#8220;TDDDG&#8221;) and the other relevant data protection regulations only to the extent necessary. Insofar as the processing of personal data is based on Art. 6 para. 1 sentence 1 lit. f GDPR, the purposes mentioned, subject to further interests to be specified in more detail, also represent our legitimate interests.   <\/p>\n\n<p><strong>4.1<\/strong><\/p>\n\n<p>If you use the website for informational purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR): <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Host name of the accessing computer (IP address)<\/li>\n\n\n\n<li>Date and time of the request<\/li>\n\n\n\n<li>Time zone difference to Greenwich Mean Time (GMT)<\/li>\n\n\n\n<li>Browser type\/version<\/li>\n\n\n\n<li>Operating system used<\/li>\n\n\n\n<li>Referrer URL (the previously visited page)<\/li>\n\n\n\n<li>Content of the request (specific page)<\/li>\n\n\n\n<li>Amount of data transferred in each case<\/li>\n\n\n\n<li>Access status\/HTTP status code<\/li>\n<\/ul>\n\n<p>This data is not merged with other data sources, and the data is deleted after a statistical evaluation.<\/p>\n\n<h2 class=\"wp-block-heading\">5. cookies<\/h2>\n\n<p>We do not use cookies on our website ze-innovation.de and do not store any data for analysis or marketing purposes.<\/p>\n\n<h2 class=\"wp-block-heading\">6. further functions and offers of our website<\/h2>\n\n<p><strong>6.1<\/strong><\/p>\n\n<p>In general, you can use this website without personal data being collected separately. In some cases, however, we require personal data from you. This data is collected and stored by us to process your request:  <\/p>\n\n<p><strong>a)<\/strong> when you contact us via the contact form. For this purpose, we collect your first and last name, your e-mail address and, if applicable, your address and telephone number. <\/p>\n\n<p>The legal basis for the processing of your personal data in these cases is Art. 6 para. 1 sentence 1 lit. b and f GDPR.  <\/p>\n\n<p><strong>6.2<\/strong><\/p>\n\n<p>If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.<\/p>\n\n<h2 class=\"wp-block-heading\">8. data transfer to third parties<\/h2>\n\n<p>Our websites also use other services that do not use cookies, but which use other technologies, such as JavaScript codes, to read data from or store data in visitors&#8217; end devices.  <\/p>\n\n<p>The legal basis for the use of the plug-ins is &#8211; unless otherwise stated below &#8211; Section 25 (1) TDDDG, whereby the subsequent further processing of your data also requires consent in accordance with Art. 6 (1) sentence 1 lit. a GDPR; i.e. the integration only takes place if you have given your consent to the storage or reading of information on your end device and additionally your consent to the subsequent further processing of personal data for analysis and advertising purposes (so-called &#8220;2-click solution&#8221;).   <\/p>\n\n<h2 class=\"wp-block-heading\">9. data transfer to a third country<\/h2>\n\n<p>As part of our business relationships, your personal data may be passed on or disclosed to third-party companies. These may also be located outside the European Economic Area (EEA), i.e. in third countries. Such processing takes place exclusively to fulfill contractual and business obligations and to maintain your business relationship with us. We will inform you about the respective details of the transfer at the relevant points below.   <\/p>\n\n<p>The European Commission certifies that some third countries have a level of data protection comparable to the EEA standard by means of so-called adequacy decisions (a list of these countries and a copy of the adequacy decisions can be found here: https:\/\/ec.europa.eu\/info\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en). However, in other third countries to which personal data may be transferred, there may not be a consistently high level of data protection due to a lack of legal provisions. If this is the case, we ensure that data protection is adequately guaranteed. This is possible via binding company regulations, standard contractual clauses of the European Commission for the protection of personal data, certificates or recognized codes of conduct.  <\/p>\n\n<p>Please note that if personal data is transferred to the USA, even if this is done on the basis of standard contractual clauses, it cannot be ruled out that the US security authorities, which have extensive powers, may access your personal data at any time and without cause or compel the disclosure of your data by the US company concerned. This applies even if the servers are located in Europe. You have no effective legal remedies against this. Other third countries may also lack a level of data protection comparable to that in Europe.   <\/p>\n\n<p>Please also note that, in the vast majority of cases, the transfer of your personal data to a third country such as the USA cannot be based on your consent in accordance with Art. 49 GDPR.<\/p>\n\n<p>With regard to the individual services, we will inform you at the appropriate point about the legal basis (e.g. standard contractual clauses) on which the data transfer to third countries takes place. Please contact our data protection officer if you would like more information on this. <\/p>\n\n<h2 class=\"wp-block-heading\">10. objection or revocation against the processing of your data<\/h2>\n\n<p><strong>10.1<\/strong><\/p>\n\n<p>If you have given your consent to the processing of your data, you can withdraw this at any time. Such a revocation affects the permissibility of the processing of your personal data after you have given it to us. <\/p>\n\n<p><strong>10.2<\/strong><\/p>\n\n<p>Insofar as we base the processing of your personal data on the balancing of interests, you can object to the processing. This is the case if, in particular, the processing is not necessary for the performance of a contract with you, which is described by us in the following description of the functions. When exercising such an objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and will either discontinue or adapt the data processing or show you our compelling reasons worthy of protection on the basis of which we will continue the processing.   <\/p>\n\n<p><strong>10.3<\/strong><\/p>\n\n<p>Of course, you can object to the processing of your personal data for advertising and data analysis purposes at any time.
